2. Preamble / Scope:
These General Terms of Sale (the "Terms") are entered into between:
SuperBolide, a French simplified joint-stock company, with share capital of €49300, registered with the Annecy Trade and Companies Register (RCS) under number 848 284 618 (SIREN Number), having its registered office at 3 allée des Vernaies, 74230 THÔNES, France, further identified in the Legal Notices available on the website (hereinafter "the Seller");
And
any individual of legal age, acting as a Client for personal, non-professional purposes, who places an order through the website https://superbolide.com (hereinafter "the Client" or "the Client").
These Terms govern all sales of sunglasses and related products (hereinafter the "Products") made between the Seller and the Client through the website, without exception.
These Terms apply exclusively to Clients within the meaning of the French Consumer Code, i.e., any individual acting for purposes which do not fall within the scope of their commercial, industrial, craft, liberal, or agricultural activity. They do not apply to professional or business Clients, who are not covered by these Terms and should contact the Seller directly for any commercial order.
These General Terms of Sale, together with the Order Form and the Order Confirmation, constitute the sales contract between the Client and SuperBolide regarding the sale of the ordered Products. These General Terms of Sale also apply to any user of the website, whether or not they have placed an Order.
Any Order placed on the website www.superbolide.com implies that the Client fully and unreservedly accepts these General Terms of Sale in their entirety. The Client acknowledges having read and accepted these Terms prior to placing an order, by ticking the corresponding box at the time of order confirmation. In the event of disagreement with these Terms, the Client must not use the website.
SuperBolide reserves the right to adapt or modify these General Terms of Sale at any time and without prior notice. Such adaptations or modifications shall apply to any Order placed thereafter. The Terms applicable to a given Order are those that were available on the website and accepted by the Client on the date the Order was placed.
3. Definitions:
Terms and expressions identified with a capital letter in these General Terms of Sale shall have the meaning set out below (whether used in the singular or the plural):
· "Client(s)": refers to an individual consumer who uses the Website and purchases one or more Product(s) or Service(s) for personal purposes, through the Website or via SuperBolide.
· "General Terms of Sale": refers to this document, i.e., the terms and conditions governing the relationship between SuperBolide and the Client.
· "Order(s)": refers to the Client's purchase order for one or more Product(s), placed through the Website or via Client Service.
· "Product(s)": refers to a product offered for sale on the Website.
· "SuperBolide": refers to the Seller, i.e., the company SuperBolide.
· “Website": refers to the website accessible at www.superbolide.com and www.superbolide.fr.
4. Products / Services:
4.1. Product Characteristics:
The Products offered for sale are those presented on the website https://superbolide.com at the time of the Client's visit, within the limits of available stock. Each Product is presented with a description setting out its essential characteristics (model, color, material, dimensions, etc.).
This description, together with any accompanying photographs, constitutes the reference description of the Products. Photographs are provided for illustrative purposes only and are not contractually binding, notwithstanding the Seller's efforts to represent the Products as accurately as possible.
All the products offered comply with French legislation.
SuperBolide reserves the right to modify, at any time and without prior notice, the range of Products offered on the website, including by adding, withdrawing, or discontinuing any Product or model, without this giving rise to any right to compensation for the Client.
4.2. Product Availability:
Products are offered for sale within the limits of available stock. In the event that, after the placement of an order, a Product proves to be unavailable, the Client will be informed as soon as possible.
The order will then be either amended, with the Client's agreement, or cancelled, with a full refund of the amounts paid for the unavailable Product, within the timeframes set out in the "Payment" section of these Terms.
5. Regulatory Compliance and Product Safety:
The sunglasses sold by SuperBolide are designed and manufactured in accordance with the applicable requirements of EU Regulation 2016/425 on personal protective equipment (PPE).
The products bear the CE marking, certifying their compliance with the applicable essential health and safety requirements. This CE marking applies to sales within the European Union and the European Economic Area. For sales to countries outside the EU/EEA, other local certifications or standards may apply (for example, UKCA marking for the United Kingdom), and the Customer is invited to verify the requirements applicable in their country of residence.
The sunglasses are intended to protect the eyes against solar radiation under the normal conditions of use provided for by their filter category.
Protective characteristics, in particular the filter category, are indicated on the product, its packaging, or the accompanying documentation.
Sunglasses sold by SUPERBOLIDE are not suitable for:
- Direct observation of the sun;
- Protection against artificial sources of radiation;
- Protection against mechanical impacts or projections;
- Night-time driving or driving in low-visibility conditions where the filter category does not permit it.
The Customer agrees to comply with the normal conditions of use as well as the instructions provided with the product.
The EU Declaration of Conformity is available upon request or via the dedicated page of the website, where made available.
6. Prices:
6.1. Generalities:
For deliveries within the European Union, the prices indicated are expressed inclusive of all taxes ("All Taxes Included") and do not include preparation and delivery fees.
The price applicable to an order is the price displayed on the product sheet on the date of purchase.
Delivery fees may be added to the order, depending on its total amount and the delivery country.
For deliveries outside the European Union, prices are expressed exclusive of any applicable taxes. The Client agrees to pay, where applicable, all taxes, VAT, and customs duties that may be required by the delivery country. These charges may be collected directly by the carrier upon delivery. SuperBolide shall not be held liable in the event the Client fails to pay such taxes or duties. Should the Client refuse the package on these grounds, SuperBolide reserves the right to charge the Client for the return shipping costs of the package, together with a flat order preparation fee.
The Client alone is responsible for verifying the import requirements applicable to the ordered Products under the laws of the destination country. SuperBolide is under no obligation to verify or inform the Client of applicable customs duties or other taxes. To obtain this information, the Client is advised to contact the competent authorities of their country.
The total amount indicated in the confirmation order sent by SuperBolide (price of the Products and delivery fees) constitutes the total price payable by the Client.
SuperBolide reserves the right to modify its prices at any time.
The total price of a paid order includes:
- The total price of the Products purchased, after deduction of any applicable discounts;
- The order preparation fees;
- The shipping fees of the order.
6.2. Price Modifications:
In the context of commercial operations, flash sales, or promotions, the displayed prices may be temporarily reduced for a duration specified on the website.
Such temporary price reductions shall not give rise to any refund claim from a Client who purchased the same Product(s) at a higher price outside the promotional period. Conversely, SuperBolide undertakes to honor the price displayed on the Website on the date the order is validated, even in the event of a subsequent price increase.
6.3. Price Display Error:
Despite the Seller's best efforts, the prices displayed on the website may occasionally contain errors. In the event of a manifest pricing error — that is, a price that a reasonably attentive Client could not, in good faith, believe to be accurate — SuperBolide undertakes to contact the Client to inform them of the error, and to offer either to pay the price difference or to cancel the order, at the Client's discretion.
7. Order Process:
Only persons with the legal capacity to enter into contracts relating to the Products offered for sale on the Website may place an Order. When placing an Order, the Client warrants that they have full legal capacity to accept these General Terms of Sale, place an Order, and conclude a sale, and that they are fully authorized to use the payment method provided, with sufficient funds to cover all costs resulting from the purchase.
To place an Order, the Client must follow the steps below:
- Select the desired Product(s) from those available on the website www.superbolide.com.
- Log in to an existing account or create a Client account by providing the required information (name, first name, physical address, phone number, email address).
- Review and confirm the details of the Order (Products, price, delivery address).
- Select the desired delivery method and payment method.
- Accept these General Terms of Sale by ticking the corresponding box.
- Confirm the Order via the secure payment module (SSL).
Any fanciful or false personal information may result in the closure of the Client's account and the cancellation of their Order.
The Client is responsible for all actions carried out on the Website using their login credentials and password. Any registered user of the Website shall be bound by any Order placed using their login credentials, subject to the right of withdrawal set out in Article 9.
Clicking to confirm the Order constitutes an electronic signature with the same legal value as a handwritten signature and shall constitute the Client's irrevocable acceptance of these General Terms of Sale. The sales contract shall only be formed upon SuperBolide sending a confirmation email acknowledging registration of the Order, which will include a summary of the Order.
SuperBolide shall not be held liable for any data entry errors made by the Client, nor for any resulting delivery delays or errors. In such cases, any costs incurred in connection with re-shipment shall be borne by the Client.
Once the Order has been registered, a detailed invoice, printable by the Client, will be made available under the "Your Account" section of the website.
SuperBolide reserves the right to refuse or cancel any Order, in particular in the event of:
- · Unavailability of the Products ordered.
- · Manifest pricing error.
- · Suspected fraud or misuse of a payment method.
- · Existing dispute with the Client concerning a previous Order and/or the payment of an invoice.
- · False or incomplete personal information provided by the Client.
8. Payment Terms:
8.1. Accepted Payment Methods:
Payment for Orders placed on the website may be made by credit card (CB, Visa, Eurocard, Mastercard) or via PayPal. As soon as payment has been received in accordance with the conditions set forth in this article, the Seller shall send the Client a confirmation email to the email address provided.
8.2. Timing of Payment:
The price of the Products, together with shipping costs and any applicable Order processing fees, is due in full at the time the Order is placed. No partial payment or deposit is accepted; the total amount is charged upon confirmation of the Order.
8.3. Payment Security:
All payments made on the website are processed through Stripe, a PCI-DSS compliant payment provider, ensuring that card data is transmitted and stored in accordance with the highest industry security standards. Card data provided by the Client at the time of payment is never stored on SuperBolide's servers.
For cardholders within the European Union, payments are secured through Strong Customer Authentication (3D Secure), in accordance with the requirements of the revised Payment Services Directive (PSD2).
SuperBolide implements all necessary technical measures to ensure the security and confidentiality of data transmitted on the website www.superbolide.com, including through SSL (Secure Socket Layer) encryption, ensuring that no data is transmitted unencrypted over the network.
8.4. Payment by Credit Card:
The Client undertakes to pay the price stipulated for the ordered Product(s), including the price of the items, shipping costs, and any applicable Order processing fees. Only the following credit cards will be accepted as payment: CB, Visa, Eurocard, Mastercard. The card is charged at the time the Order is confirmed. The Client warrants that they hold any authorizations required to use the chosen card payment method when placing the Order. As part of its efforts to prevent online fraud, SuperBolide reserves the right to request a copy of an identity document and proof of address for any payment.
8.5. Payment with PayPal:
Payments may also be made via PayPal. This service allows for secure online payment by logging in with an email address and password, without disclosing banking details to SuperBolide. There is no need to pre-fund a PayPal account; the funding source selected by the Client (payment card or bank account) is automatically debited at the time of the transaction. Use of PayPal is subject to PayPal's own terms and conditions, available on the PayPal website.
The Seller shall not charge the Client any fees in excess of the costs it incurs for the use of a given means of payment.
9. Delivery
9.1. Generalities:
The Products are delivered to the delivery address provided by the Client during the Order process. In the event of an error in the delivery details provided, SuperBolide shall not be held liable for any resulting failure to deliver. In such cases, the costs incurred for a new delivery shall be borne by the Client and invoiced at their actual cost.
Orders comprising in-stock, non-customized Products are delivered in a single package.
For orders including one or more Products unavailable at the time of dispatch, SuperBolide reserves the right to ship the Order without the unavailable Products. In this case, the Client will be refunded or credited with a voucher equivalent to the amount of the unavailable Products.
9.2. Delivery Zones:
The Products are delivered to the countries listed on the website at the time of the Order (the “Eligible Countries”). The Client is responsible for verifying that the delivery address is located within one of these countries prior to placing an Order.
The Seller reserves the right to modify the list of Eligible Countries at any time and to refuse any Order that cannot be fulfilled due to legal or logistical constraints.
For deliveries outside the European Union, the Products may be subject to customs duties, import taxes, or other charges imposed by the destination country. These charges are not included in the Product price or shipping costs and shall be borne solely by the Client. They are payable directly to the relevant authorities or carriers in accordance with local regulations.
9.3. Delivery Methods and Costs:
Delivery methods and applicable shipping fees are displayed to the Client prior to Order confirmation. Shipping costs are calculated based on factors such as the destination country, the weight or volume of the Products, and the selected delivery method.
Shipments are carried out by La Poste or any other carrier chosen by the Seller. Depending on the destination, several delivery options may be offered, including home delivery, pick-up point delivery, or international services.
9.4. Delivery Times:
Orders are prepared and dispatched within a maximum of five (5) business days from Order confirmation, subject to Product availability.
Delivery times indicated on the website are estimates provided for information purposes only and may vary depending on the destination and the selected delivery method. These times are calculated from the date of dispatch.
When several Products are ordered at the same time and have different dispatch times, the effective dispatch time may correspond to the longest of these timeframes, as the entire Order is prepared once all the Products it comprises are in stock at SuperBolide. SuperBolide reserves the right to split such shipments, in which case shipping costs will be charged on the basis of a single shipment.
In accordance with Article L.216-1 of the French Consumer Code, in the absence of a specific delivery date or timeframe agreed upon at the time of the Order, the Seller undertakes to deliver the Products within a maximum period of thirty (30) days from the conclusion of the contract.
9.5. Delivery and Transfer of Risk:
Delivery is deemed to have taken place when the Client, or a third party designated by the Client, takes physical possession
of the Products.
In accordance with Article L.216-4 of the French Consumer Code, the risk of loss or damage to the Products is transferred to the Client only upon delivery, unless the Client has chosen a carrier other than the one proposed by the Seller, in which case the risk is transferred upon handover of the Products to the selected carrier.
9.6. Absence or Failure to Collect:
In the event of absence at the time of delivery, the carrier may leave a notice informing the Client of the procedures for collecting the parcel.
For deliveries to pick-up points, the Client must collect the parcel within the timeframe specified by the carrier. Failing this, the parcel may be returned to the Seller.
If a parcel is returned due to non-collection or an incorrect delivery address, the Seller will contact the Client to arrange re-delivery. Additional shipping costs may be charged. In the absence of a response from the Client within a reasonable period, the Order may be cancelled and refunded, excluding the initial shipping costs.
9.7. Damaged or Non-Compliant Products:
Upon delivery, the Client is invited to check the condition and conformity of the Products.
In the event of visible damage or anomaly, the Client is encouraged to make reservations with the carrier and to contact the Seller as soon as possible.
However, the absence of reservations upon delivery does not affect the Client’s statutory rights, including the legal guarantee of conformity and the legal warranty against hidden defects.
The Client may contact the Seller through the contact details provided on the website in order to report any issue and obtain appropriate assistance.
9.8. Delivery Issues and Claims:
In the event of delay, damage, or total or partial loss during transport, the Client must notify SuperBolide by email (via the contact form available on the website www.superbolide.com) as soon as possible, in accordance with the procedure set out above regarding inspection of the parcel upon delivery.
SuperBolide shall not be held liable for any delay, damage, or loss attributable to the carrier and not reported by the Client. Where applicable, it is the Client's responsibility to also pursue any corresponding claim directly with the carrier.
10. Right of Withdrawal:
10.1. Withdrawal Rights for EU Customers:
In accordance with Article L.221-18 of the French Consumer Code, the EU Client has a period of fourteen (14) days from the date of receipt of the Order to exercise their right of withdrawal, without having to provide any reason. Return costs, where applicable, shall be borne by the Client in accordance with Articles L.221-23 to L.221-25 of the French Consumer Code.
The Client must submit their return request by contacting Client Service. They then have fourteen (14) days from the date they notify their decision to withdraw to return the Products. Returned Products must be in perfect condition, unworn, and in their original packaging.

The product must be returned:
- In its original condition;
- Undamaged;
- Together with any accessories, instructions, and packaging.
Return costs shall be borne by the Client, unless otherwise provided by law.
The refund shall be made within a maximum period of fourteen (14) days from the date the product is recovered or from receipt of proof of shipment of the return.
- · Exceptions to the Right of Withdrawal:
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to the supply of goods made to the Client's specifications or clearly personalized, such as customized or engraved Products, or to any other category of goods expressly excluded by law.

10.2. Withdrawal Rights for Non-EU Customers:
The right of withdrawal described above is granted in accordance with European Union Consumer protection law and applies to Clients residing within the European Union. For Clients residing outside the European Union, withdrawal rights, return conditions, and refund procedures may differ and shall be governed by the mandatory consumer protection laws, if any, applicable in the Client's country of residence. Such Clients are invited to verify the rules applicable in their jurisdiction prior to placing an Order.
Notwithstanding the above, and as a commercial policy, SuperBolide agrees to apply the same withdrawal conditions set out in this section to all Clients, regardless of their country of residence, unless otherwise required by mandatory local law.
11. Legal and Commercial Warranties:
11.1. Legal Guarantee of Conformity:
The Client benefits from the legal guarantee of conformity provided for under Articles L.217-3 et seq. of the French Consumer Code. Under this guarantee, the Client has a period of two (2) years from delivery of the Product to obtain its repair or replacement in the event of a lack of conformity.
Any lack of conformity appearing within twenty-four (24) months of delivery is presumed to have existed at the time of delivery, unless proven otherwise or unless this presumption is incompatible with the nature of the Product or of the defect concerned.
The Client may choose between repair and replacement of the Product. However, in accordance with Article L.217-9 of the French Consumer Code, the Seller may choose a different remedy where the Client's preferred option would entail a cost manifestly disproportionate to the alternative. Where the Seller refuses to bring the Product into conformity, or fails to do so within a reasonable time, the Client may, in accordance with Article L.217-14 of the French Consumer Code, request either rescission of the sale or a reduction of the price.
The legal guarantee of conformity applies regardless of any commercial warranty that may be granted (see below).
11.2. Warranty Against Hidden Defects:
The Client also benefits from the warranty against hidden defects provided for under Articles 1641 et seq. of the French Civil Code. In this case, the Client may choose between rescission of the sale or a reduction of the sale price, in accordance with Article 1644 of the French Civil Code.
11.3. Commercial Warranty:
SuperBolide does not offer any commercial warranty in addition to the legal guarantees described above. The Client's rights are therefore limited to the legal guarantee of conformity and the warranty against hidden defects set out in this section, which apply automatically and free of charge, regardless of any statement to the contrary that may appear on the Product packaging or on the website.
11.4. Making a Warranty Claim:
To make a claim under either of the above guarantees, the Client must contact SuperBolide's Client Service via the "Product Returns" section of the website, or return the Product for inspection directly to the following address, together with dated proof of purchase and a letter explaining the reason for the claim:

Products must be returned with their accessories and instructions and, where possible, in their original packaging.
These guarantees do not cover normal wear and tear, nor damage resulting from accident, negligence, misuse, or exposure of the Product to excessive temperatures.
12. Liability:
The Products offered on www.superbolide.com are compliant with French legislation and the standards in force at the time of sale.
SuperBolide shall not be liable for any failure or delay in performance resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code, nor from events beyond its reasonable control, including but not limited to stock shortages caused by supply disruptions, strikes affecting postal or delivery services, computer failures, or telecommunications/network outages.
SuperBolide shall not be liable for any indirect or unforeseeable loss or damage, or where non-performance is attributable to the Client or to the unforeseeable and insurmountable act of a third party to the contract, except where mandatory law provides otherwise.
As the Site is hosted by an external service provider, SuperBolide shall not be liable for temporary interruptions of service, bugs, inaccuracies or omissions in the information displayed on the Site, or for damage resulting from fraudulent third-party intrusion, except in cases of fault attributable to SuperBolide or where mandatory law provides otherwise. SuperBolide shall not be liable for any loss of data or files. The Client is responsible for taking any necessary backups.
Photographs, graphics, and descriptions of the Products are provided for indicative purposes only and may not fully reflect the actual Products. They do not constitute a contractual guarantee beyond the mandatory legal rights of the Client.
The Client shall use the Products in accordance with their intended purpose and the instructions provided at the time of sale. SuperBolide shall not be liable for damage resulting from misuse, improper maintenance, normal wear and tear, impact, dropping, mishandling, or force majeure.
The sunglasses marketed by SuperBolide are intended solely for sun protection, in accordance with their filter category, and do not constitute protective equipment against specific industrial, sporting, or professional risks.
The Client is responsible for verifying that the Products comply with the legislation and standards applicable in the country of destination where such rules differ from those in France, subject to any mandatory consumer protection provisions applicable in that country
13. Personal Data:
Personal data collected in connection with the Order process is processed by SuperBolide in accordance with Regulation (EU) 2016/679 of 27 April 2016 (the "General Data Protection Regulation" or "GDPR) and the French Data Protection Act of 6 January 1978, as amended ("Loi Informatique et Libertés"),
The Client has the right to access, rectify, erase, and object to the processing of their personal data, as well as the right to restrict processing, the right to data portability, and the right to define instructions regarding the retention, deletion, and communication of their data after death, subject to applicable legal conditions.

For further information regarding the processing of personal data, including purposes, legal bases, retention periods, recipients, and the Client’s right to lodge a complaint with the competent supervisory authority, the Client is invited to consult SuperBolide’s Privacy Policy available on the website.
14. Intellectual Property:
All content appearing on the website, including but not limited to photographs, product descriptions, illustrations, logos, trademarks, graphic elements, and any other protected material, is protected by applicable intellectual property laws and remains the exclusive property of SuperBolide or its respective licensors.
No transfer of intellectual property rights is made to the Client by virtue of the sale of the Products or the use of the website.
Any reproduction, representation, distribution, extraction, adaptation, or use, in whole or in part, of such content without prior written authorization from SuperBolide or the relevant rights holder is strictly prohibited, except as expressly permitted by law.
Product images and descriptions are provided for information purposes only and may not be reused for commercial purposes without authorization.
15. Complaints and Consumer Mediation:
Any complaint can be submitted via the contact form available in the "Help / Contact" section of the website. SuperBolide will respond to the Client as soon as possible.
Before initiating mediation or any legal action, the Client may seek an amicable solution, in particular with the help of a professional association, a consumer association or any other adviser of their choice.
In case of dispute that cannot be satisfactorily resolved:

Any dispute that cannot be resolved amicably with our customer service may be submitted to the competent courts as set out in the "Governing Law and Jurisdiction" section of these Terms.
16. Governing Law and Jurisdiction:
These General Conditions and the transactions arising therefrom shall be governed by French law, without prejudice to any mandatory consumer protection provisions applicable in the Client’s country of residence.
These General Conditions are drawn up in French and English. In the event of any discrepancy, inconsistency, or dispute as to interpretation between language versions, the French version shall prevail, except where mandatory law requires otherwise.
Any dispute arising out of or in connection with these General Conditions that cannot be settled amicably shall be submitted to the competent courts. Subject to mandatory consumer protection rules, jurisdiction is expressly attributed to the French courts. Where applicable, the Client may also bring proceedings before the court of the place where the Client was domiciled at the time of conclusion of the contract or the occurrence of the harmful event, in accordance with applicable law.
17. Modification of General Terms of Sale:
The Seller reserves the right to modify these General Terms of Sale at any time. Such modifications shall apply only to orders placed after the updated version has been made available on the Site or communicated to the Customer.
Any order placed after such update shall constitute acceptance of the then-current version of the General Terms of Sale.
