2. Preamble / Scope:
These General Terms of Use (the "Terms of Use") are issued by SuperBolide, a French simplified joint-stock company, with share capital of €49,300, registered with the Annecy Trade and Companies Register (RCS) under number 848 284 618 (SIREN Number), having its registered office at 3 allée des Vernaies, 74230 THÔNES, France, further identified in the Legal Notices available on the website (hereinafter "SuperBolide" or "the Seller").
These Terms of Use govern access to and use of the website www.superbolide.com (the "Website") by any visitor or user (the "User"), regardless of whether they place an Order. They apply in addition to, and independently of, the General Terms of Sale, which specifically govern the contractual relationship arising from the purchase of Products on the Website.
Access to and use of the Website implies full and unreserved acceptance of these Terms of Use by the User. Users who do not accept these Terms of Use must refrain from using the Website.
These Terms of Use apply to any User of the Website, whether acting as a consumer or as a professional. Users purchasing Products for personal, non-professional purposes are additionally subject to the General Terms of Sale, which apply specifically to consumers, as defined therein.
3. Access to the Site:
Access to the Website is free of charge for any User with an internet connection. Certain features, such as placing an Order or accessing a personal account, may require the User to register and create an account by providing the information requested.
The User is responsible for ensuring that their device, browser, and internet connection are compatible with the technical requirements of the Website. SuperBolide does not guarantee that the Website will be compatible with all hardware or software configurations and shall not be held liable for any difficulty in accessing or using the Website resulting from the User's equipment, browser, or internet connection.
SuperBolide reserves the right to suspend, restrict, or interrupt access to all or part of the Website at any time, without prior notice and without liability, in particular for maintenance purposes, to preserve the security or integrity of the Website, or in the event of misuse of the Website by a User.
Access to the Website, and particularly the creation of an account, is reserved for individuals of legal age. By using the Website or creating an account, the User warrants that they meet this age requirement.
4. User Account:
Access to certain features of the Website, particularly the placing of an Order, requires the User to create a personal account by completing the registration form and providing the information requested, such as their name, email address, and delivery details.
The User warrants that the information provided during registration, and at any time thereafter, is accurate, complete, and up to date, and undertakes to update this information without delay in the event of any change. SuperBolide shall not be held liable for any consequences resulting from inaccurate, incomplete, or outdated information provided by the User.
The User is solely responsible for maintaining the confidentiality of their login credentials (username and password) and for all activities carried out through their account. The User undertakes to notify SuperBolide without delay of any unauthorized use of their account or any breach of security of which they become aware.
SuperBolide reserves the right to suspend or terminate a User's account, without prior notice, in the event of a breach of these Terms of Use, suspected fraud, misuse of the Website, or provision of false or misleading information, without prejudice to any other action SuperBolide may be entitled to take.
The User may request the deletion of their account at any time by contacting SuperBolide's Client Service through the contact details available on the Website. Account deletion shall not affect any Order already placed, nor any obligation arising prior to the deletion, and shall be carried out subject to any data retention obligations applicable to SuperBolide under applicable law. For further information regarding the processing, retention, and deletion of personal data, the User is invited to consult SuperBolide's Privacy Policy, available on the Website.
5. Acceptable Use / Prohibited Conduct:
When using the Website, the User agrees not to:
- Use the Website for any unlawful purpose or in any manner that violates applicable laws or regulations.
- Attempt to breach, circumvent, or compromise the security or integrity of the Website, its servers, or any connected network.
- Use any automated means, including scraping, crawling, or data mining tools, to extract, collect, or reuse data or content from the Website without SuperBolide's prior written authorization.

Except as expressly authorized in writing by SuperBolide, the User may not reproduce, resell, distribute, or otherwise exploit, for commercial or other purposes, all or part of the content, features, or elements of the Website, in accordance with the Intellectual Property provisions set out in the Legal Notices available on the Website.
User-Generated Content:
Where the Website allows Users to submit content, such as product reviews, comments, or photographs (the "User Content"), the following rules apply:
By submitting User Content, the User grants SuperBolide a non-exclusive, worldwide, royalty-free license to reproduce, display, adapt, and publish such User Content on the Website and, where applicable, on SuperBolide's social media accounts or other communication channels, for the purposes of operating and promoting the Website and its Products.
The User warrants that they hold all necessary rights to the User Content they submit, and that such content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
SuperBolide reserves the right, at its sole discretion, to moderate, refuse to publish, or remove any User Content that is unlawful, offensive, defamatory, or that infringes the rights of a third party, without prior notice.
6. Intellectual Property:
All content available on the Website, including but not limited to text, images, photographs, illustrations, logos, graphic design, layout, source code, and databases (the "Content"), is either owned by SuperBolide or used under license, and is protected under the French Intellectual Property Code and, where applicable, international copyright conventions, as further detailed in the Intellectual Property section of the Legal Notices available on the Website.
Except as expressly authorized in writing by SuperBolide, any reproduction, representation, adaptation, modification, distribution, or exploitation of all or part of the Content, by any means and on any medium whatsoever, is strictly prohibited.
The trademarks, trade names, and logos displayed on the Website, including "SuperBolide," are the exclusive property of SuperBolide, or of their respective owners where third-party trademarks are displayed with authorization. SuperBolide has no control over such third-party websites and shall not be held liable for their content, availability, or privacy or data protection practices. The inclusion of a hyperlink on the Website does not imply any endorsement by SuperBolide of the linked website or its operator. 8. Availability and Liability:
SuperBolide makes reasonable efforts to ensure that the Website is accessible at all times. However, SuperBolide does not guarantee uninterrupted, error-free, or fault-free access to the Website, and reserves the right to modify, suspend, or discontinue, temporarily or permanently, all or part of the Website or its features, at any time and without prior notice, in particular for maintenance, technical, or security reasons, without incurring any liability as a result.
To the extent permitted by applicable law, SuperBolide shall not be held liable for any damage of any kind resulting from the use of, or the inability to use, the Website, including damage caused by technical failures, viruses or other malicious code, or the actions of any third party, save in the case of intentional misconduct or gross negligence on the part of SuperBolide. The User acknowledges that it is their responsibility to take appropriate measures to protect their own device and data, including the use of up-to-date antivirus software.
SuperBolide shall not be held liable for any failure to perform, or delay in performing, its obligations under these Terms of Use where such failure or delay results from a case of force majeure within the meaning of Article 1218 of the French Civil Code.
9. Personal Data and Cookies:
In connection with the use of the Website, SuperBolide may collect and process personal data relating to the User, including data collected through the use of cookies and similar technologies. Such processing is carried out in accordance with SuperBolide's Privacy Policy and Cookie Policy, both available on the Website, which describe in detail the personal data collected, the purposes of such processing, and the rights available to the User.

10. Governing Law and Jurisdiction:
These Terms of Use are governed by French law.
If the User is a consumer residing in the European Union, mandatory consumer protection provisions of the law of the User's country of residence shall apply, and the User may bring proceedings before the courts of their place of residence, in accordance with applicable European Union regulations.
For any other User, and to the extent permitted by any mandatory local consumer protection laws, any dispute arising from or in connection with these Terms of Use shall be submitted to the competent courts within the jurisdiction of SuperBolide's registered office.
11. Modifications of Terms of Use:
SuperBolide reserves the right to modify these Terms of Use at any time, in particular to reflect changes in the Website's features, applicable law, or SuperBolide's practices.
The applicable version of these Terms of Use is the one available on the Website at the time of the User's visit. Continued use of the Website following any such modification constitutes acceptance of the updated Terms of Use by the User.
